 The annual report of the Special Rapporteur on the right to education:

The annual report of the Special Rapporteur on the right to education to be presented to the Human Rights Council in 2010 will focus on the right to education of migrants, refugees and asylum-seekers.


 

With the aim of hearing from all interested persons and/or organisations about their experiences, concerns and thoughts in the provision of education for migrants, refugees and/or asylum seekers, we seek and would welcome your cooperation by responding to this questionnaire as fully as possible. 

The focus of the report, and as such of the proposed questionnaire, is on persons who are living outside the territory of the county of which they are nationals or citizens, irrespective of their age. It includes migrants in regular or irregular situations, and persons who are subject to the legal protection of the status of refugee and/or those who are seeking asylum.

 

To ensure a full reflection in the answers of the differing status, needs and experiences of migrants and refugees and/or those who are seeking asylum, where appropriate the questions have been split into one of two categories: (i) migrants and (ii) refugees and/or asylum seekers. Should one category not apply to your domain of expertise please simply pass on to the next question.


In responding to this questionnaire, particular attention should be paid to the principle of non-discrimination, in conjunction with the four essential features previously identified as critical components of the right to education, namely, availability, accessibility, acceptability and adaptability.

In order for the information received to be used for the report of the Special Rapporteur, submission of responses is encouraged as soon as possible and no later than 20 January 2010


 

Le rapport annuel du Rapporteur spécial sur le droit à l’éducation qui sera présenté au Conseil des droits de l’homme en 2010, traitera du droit à l’éducation des migrants, réfugiés et demandeurs d’asile. 
Le Rapporteur spécial souhaiterait écouter de toutes les parties intéressées, leurs expériences, défis et succès dans la provision d’éducation pour les migrants, réfugiés et/ou demandeurs d’asile. A cet effet, il apprécierait votre collaboration pour répondre aussi bien que possible au questionnaire présenté ci-dessous. 

Pour ce rapport, le Rapporteur spécial se concentrera sur la situation des personnes vivant à l’extérieur de leur pays d’origine ou de nationalité, indépendamment de leur âge. Cela inclut les migrants en situation régulière ou irrégulière, les réfugiés et les demandeurs d’asile, indépendamment de leur statut légal dans leur pays de résidence. 

Afin d’assurer une meilleure compréhension des réponses à l’égard des différents status, besoins et expériences de migrants, réfugiés et ou demandeurs d’asile, certaines questions ont été divisées en deux catégories: (i) migrants et (ii) réfugiés et demandeurs d’asile. Si une de ses catégories ne corresponde pas à votre domaine d’expertisse, s’il vous plaît, passez simplement à la question suivante. 

Pour la préparation du questionnaire, une attention particulière devrait être accordée au principe de non-discrimination, en accord avec les quatre composantes essentielles sur le droit à l’éducation identifiées précédemment, à savoir, la disponibilité, l’accesibilité, l’acceptabilité et l’adaptabilité. 


Vu la capacité limitée pour effectuer des traductions, il est encouragé de soumettre les contributions dans une langue de travail de l’ONU et de transmettre les réponses par voie électronique à vernormu@yahoo.es ou par courrier à Vernor Muñoz, PO Box 1245 – 1007, Centro Colon, Costa Rica. 

Afin que l’information reçue puisse servir à la préparation du prochain rapport, il est recommandé de soumettre les réponse le plus tôt possible, et dans tous les cas avant le 20 janvier 2010

 


 

El informe anual del Relator Especial sobre el derecho a la educación que será presentado en el Consejo de Derechos Humanos en 2010, se centrará en el derecho a la educación de migrantes, refugiados-as y demandantes de refugio. 

Con el objeto de oír de toda persona y organización interesada en el tema, sus experiencias, sus preocupaciones, y sus logros con respecto a la provisión de educación a migrantes, refugiados-as y demandantes de refugio, esperamos y agradeceríamos su cooperación a través de la respuesta al presente cuestionario. 

En el marco del informe y consecuentemente de este cuestionario, la atención será dedicada a todas aquellas personas que viven fuera del país del que poseen la nacionalidad o la ciudadanía, independientemente de la edad. Esto incluye migrantes en situación regular o irregular, refugiados y demandantes de refugio independientemente de sus estatutos legales. 

Para garantizar una reflexión exhaustiva sobre las condiciones, necesidades y experiencias de migrantes, refugiados y demandantes de refugio, hemos dividido algunas preguntas en dos categorías: (i) migrantes y (ii) refugiados-as y demandantes de refugio. Si una de dichas categorías no coincide con su ámbito de experiencia y conocimiento, simplemente pase a la pregunta siguiente. 

Al responder a este cuestionario, una atención particular deberá darse al principio de no-discriminación en conjunto con las cuatro variables esenciales previamente identificadas como componentes críticos del derecho a la educación: disponibilidad, accesibilidad, aceptabilidad y adaptabilidad.
